Terms of Service

These terms are provided for informational purposes and do not constitute legal advice. Consult a qualified attorney for legal guidance specific to your situation.

1. Introduction & Acceptance

Wingman is a WhatsApp-native AI website builder operated by Kasovy LLC, a Wyoming (USA) limited liability company. By accessing or using Wingman ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Definitions

  • "Service" — the Wingman platform, including its WhatsApp interface, AI agent, website builder, hosting, and all related tools and APIs.
  • "Merchant" — any individual or business that registers for and uses the Service.
  • "Site" — a website generated and managed through the Service on behalf of a Merchant.
  • "Agent" — the AI-powered assistant that processes Merchant instructions via WhatsApp to build and manage Sites.
  • "Content" — text, images, media, data, and other materials uploaded, generated, or displayed through the Service.

3. Account & Registration

To use Wingman, you must authenticate with a valid WhatsApp phone number. Each phone number is associated with one account. You are responsible for maintaining the security of your account and all activity that occurs under it. You must notify us immediately of any unauthorized use.

4. Service Description

Wingman allows Merchants to build and manage websites by sending messages through WhatsApp. The Service uses AI to interpret instructions, generate website code, and deploy Sites. Features include:

  • WhatsApp-based interface for site creation and management
  • AI-powered code generation and content creation
  • Automated website hosting and deployment
  • Custom domain purchase and configuration
  • Media upload and management
  • Form submission collection

5. Subscription & Billing

Wingman offers a free tier with limited changes (up to 2 site changes) and paid subscription plans with expanded capabilities. Paid subscriptions are billed through Stripe and automatically renew at the end of each billing cycle unless canceled before the renewal date. You may cancel your subscription at any time from your account settings. Refunds are handled in accordance with our refund policy. All fees are stated in USD unless otherwise specified.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Upload or distribute malicious software, spam, or harmful content
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Abuse rate limits or use automated tools to overwhelm the Service
  • Use the Service to create Sites that promote illegal activity, hate speech, or explicit content
  • Resell or redistribute the Service without authorization

7. Intellectual Property

You retain ownership of all Content you create or upload through the Service. Wingman and Kasovy LLC retain all rights to the platform, its underlying technology, templates, and branding. You grant Wingman a limited license to host, display, and process your Content solely for the purpose of providing the Service.

8. AI-Generated Content

The Service uses artificial intelligence (powered by Anthropic's Claude, Google's Gemini, and OpenAI) to generate website code, content, and design. AI-generated output may contain errors, inaccuracies, or inappropriate content. You are solely responsible for reviewing, verifying, and approving all AI-generated Content before it is published on your Site. Wingman makes no warranties regarding the accuracy, completeness, or suitability of AI-generated output.

9. Third-Party Services

The Service relies on third-party providers to deliver its functionality:

  • WhatsApp / WasenderAPI — Wingman communicates with Merchants via WhatsApp using WasenderAPI, an unofficial API. This integration is not endorsed by or affiliated with Meta/WhatsApp. Service continuity through WhatsApp is not guaranteed, and your WhatsApp account may be subject to restrictions or bans imposed by Meta at any time.
  • Cloudflare — Sites are hosted on Cloudflare Pages with media stored on Cloudflare R2. Cloudflare Workers power edge functionality.
  • GitHub — Each Merchant's Site code is stored in a dedicated GitHub repository managed by Wingman.
  • Stripe — Payment processing is handled by Stripe. Your use of Stripe is subject to Stripe's own terms of service.
  • Anthropic — AI processing is performed by Anthropic's Claude models, subject to Anthropic's usage policies.
  • Google — AI processing may use Google's Gemini models, subject to Google's terms of service.
  • OpenAI — AI processing may use OpenAI models, subject to OpenAI's usage policies.

Wingman is not responsible for outages, policy changes, or service disruptions caused by any third-party provider.

10. Service Availability & Modifications

Wingman strives for high availability but does not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the Service at any time with or without notice. We will make reasonable efforts to notify Merchants of material changes.

11. Data & Content

You own your Merchant data and Site Content. You are responsible for maintaining your own backups. Upon account deletion, Wingman will remove your data in accordance with our Privacy Policy, but cached or distributed copies may persist temporarily on edge networks. Wingman is not liable for any loss of data.

12. Limitation of Liability

To the maximum extent permitted by law, Kasovy LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total cumulative liability shall not exceed the amount you paid to Wingman in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Kasovy LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your Content, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may terminate your account at any time through your account settings or by contacting us. Wingman may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay applicable fees. Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Wyoming.
